Welcome to Opiha. These Terms govern your access to and use of the Opiha app discovery platform, operated by Opiha Ltd (the “Platform” or “Opiha”) and available at opiha.com and related services. By accessing or using the Platform, you acknowledge that you have read, understood, and agreed to be bound by these Terms. If you do not agree, please refrain from using the Platform.

Acceptance of Terms

By using the Platform, you affirm your acceptance of these Terms and any additional terms referenced herein. Opiha reserves the right to modify these Terms at any time. Any such modifications will be posted on opiha.com/terms or a comparable notice, and your continued use of the Platform after the posting constitutes your binding acceptance of the revised Terms. If you do not agree to the updated Terms, you must discontinue use of the Platform.

Intellectual Property

All material on the Platform—including, without limitation, the site design, layout, graphics, logos, text, software, and underlying code—is owned or licensed by Opiha or its licensors. Except for a limited license to access and use the Platform for its intended purposes, no rights are granted to you by implication or otherwise. You may not copy, reproduce, modify, distribute, republish, upload, forward, or transmit any portion of the Platform or its content without Opiha’s prior written consent, unless expressly permitted by applicable law.

For any content you submit, post, or display on the Platform (such as reviews or other user submissions), you grant Opiha a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, publish, translate, distribute, and display such content in connection with operating, promoting, and improving the Platform. You warrant that you own or control all rights to the content you submit and that its publication does not infringe the rights of any third party.

Third-Party Links and Hosted Apps

The Platform functions as an app discovery and hyperlinking service. Many applications linked through Opiha are hosted on external platforms, most notably the Google Play Store (the “External Apps”). Opiha does not host, develop, maintain, certify, or control these External Apps. We do not guarantee the accuracy, safety, or legality of these External Apps, and we bear no responsibility for their content, availability, or privacy practices.

Links to External Apps are provided for convenience. Access to and use of External Apps are governed by the terms of service and privacy policies of the respective third parties. By choosing to access any External App, you acknowledge and agree that Opiha is not responsible for the behavior, content, or security of those apps. Google Play’s terms apply to apps hosted there, and Opiha is not liable for any issues arising from those apps.

THE PLATFORM IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, OPIHA DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR TITLE. OPIHA DOES NOT WARRANT THAT THE PLATFORM WILL MEET YOUR REQUIREMENTS, THAT ITS OPERATION WILL BE UNINTERRUPTED OR ERROR-FREE, OR THAT IT IS SECURE FROM VIRUSES OR OTHER HARMFUL COMPONENTS.

Opiha does not guarantee the accuracy, completeness, or reliability of any content on the Platform, including information about third-party apps. Your use of the Platform and any External Apps is at your own risk, and you are responsible for implementing appropriate safeguards to protect your devices and data.

Limitation of Liability

IN NO EVENT SHALL OPIHA, ITS AFFILIATES, OR ITS LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS OR REVENUES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE PLATFORM OR ANY EXTERNAL APPS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. TO THE MAXIMUM EXTENT PERMITTED BY LAW, OPIHA’S TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR IN CONNECTION WITH THE PLATFORM SHALL NOT EXCEED THE AMOUNT, IF ANY, PAID BY YOU TO ACCESS THE PLATFORM DURING THE PRECEDING TWELVE MONTHS.

Changes to Terms

Opiha may revise these Terms from time to time. We will post the updated Terms on opiha.com/terms and indicate the date of the latest revision. Continued use of the Platform after any changes constitutes your binding acceptance of the updated Terms.

Governing Law and Jurisdiction

These Terms are governed by the laws of the jurisdiction in which Opiha operates, without regard to conflict of laws principles. Any disputes arising out of or relating to these Terms or the Platform will be resolved exclusively in the courts located in that jurisdiction, subject to applicable laws and precedents.
